Halle Berry says a photograph her ex-husband, Olivier Martinez, submitted shows no signs of injury to their son, Maceo, as the former couple continues to battle over custody.

According to USA Today, Berry argued in a Tuesday (October 13) court filing that the image shows her standing away from Maceo with her hands in her pockets.

She said the photograph does not show redness, bruising, marks on their son’s neck, or other evidence supporting Martinez’s allegations.

In a Monday (October 12) filing, Martinez said Maceo took the photograph immediately after an alleged September 26 incident because he feared he would not be believed, according to USA Today.

Martinez has accused Berry of physically abusing their 12-year-old son, alleging that she jumped on him, put her hands around his neck, and choked him.

Berry has denied the allegations, saying they were “playfully roughhousing,” and that she did not choke him. Berry has also said she was abused by an ex-partner, whom she did not identify, and described herself as a domestic violence victim and advocate.

Martinez filed for a temporary restraining order on October 1 that restricted Berry’s parenting time to daytime visits on Mondays, Tuesdays, Saturdays and Sundays. He is also seeking sole custody of Maceo.

Berry’s attorney described Martinez’s filing as “entirely meritless and deliberately misleading,” according to previous reporting. Berry’s daughter, Nahla Aubry, also submitted a declaration supporting her mother, saying she had never witnessed abusive behavior, USA Today reported.
